摘 要:制度伦理优先于个人德性伦理是西方道德哲学探讨的主题,古典亚里士多德主义在德性伦理的基础上对其作了论证,近代的启蒙思想家也从社会契约论的角度对其作出了证明。然而他们都只是在形而上学的视阈下替制度伦理的优先性寻找理论支持,这是罗尔斯所不能同意的。罗尔斯从道德发生论的角度为制度伦理优先性的合理性重新作了论证,从而克服了道德形而上学传统的缺陷,这对于反思与批判个人伦理原则至上论和制度建设具有非常重要的启发意义。The institution ethics prior to individual virtue has been the topic for western moral philosophy. Aristotelian discussed such issue on basis of its virtue ethics, and people in the Enlightenment argued about its rationality in perspective of social contract. However, both of them were simply able to find basis for the priority of institution ethics based on views of metaphysics, which Rawls does not agree to. Rawls reconstructs the priority of institution founded on moral psychology and has overcome the defects of moral metaphysics. It is of great importance to reflect on the priority of principle of individual ethics and the construction of institution.
