驰名商标在我国的异化及其解决措施

摘　　要：驰名商标制度是解决商标跨类或跨域保护的一种技术手段,驰名商标是这种技术手段的副产品。然而,由于历史原因、制度原因以及其他因素的影响,人们更多的将驰名商标理解为"品质高、信誉好"的代名词,从而造成了驰名商标在我国的异化。驰名商标的异化不仅侵害了消费者的利益,也构成了对其他经营者的不正当竞争,因此,应当对这种现象加以遏制。The well-known trademark system is a kind of technology means for solving the brand striding over the kind or cross-domain protection. The well-known trademark is a byproduct of this technology.But because of the reason of the history, system and the others, most people think the well-known trademark as the pronoun of high quality and good credit. This idea beget the well-known trademark dissimilation in our country which not only infract the benefit of consumers but also make up of unfair competition to other proprietors. So we should take effective measures to keep this phenomenon within limitation.
