论中国古代和谐理念的基本精神及其刑法化

摘　　要：中国古代和谐理念以"等差有别"、"清心寡欲"、"天人合一"为基本精神,本质上追求的是一种以君主为中心的不同等级之间的和谐。作为当时基本法律形式的中国古代刑法,必然深受这种和谐理念的影响和支配。可以说,中国古代刑法在一定程度上就是这种和谐理念的制度化形式,无论是刑事立法,还是刑事司法,都渗透着这种和谐意蕴。Chinese ancient concept of harmony takes“gradation and difference”, “pure mind with few desires” and“harmony of man with nature”as its basic spirit. Its essence is to seek a harmony between various classes with the monarch as the center. Being a basic form of law,the Chinese ancient criminal law is inevitably influenced by this harmonious idea. We can say that the Chinese ancient criminal law is institutionalized form of this harmonious idea to some extent and that he harmonious meaning is itffiltrated into both criminal legislation and criminal jurisdiction.
