摘　　要：电子证据性质的澄清是电子商务快速、健康发展中急需跨越的法律障碍。虽然当下已有不少的研究成果,但在司法实务中对电子证据性质的准确认定依然紧迫。而为实现传统商务与电子商务的自然磨合和无缝接轨,则应该在传统证据法律框架下谋求电子证据性质的界定,电子证据应是传统证据形式的电子化。Clarifying the nature of electronic evidence is the urgent legal barrier to overcome for the rapid and healthy development of E-commerce. Although some achievements are made in this sector, the nature of electronic evidence is still urgent in the judicial practice. The interface of the traditional business and E-commerce and seamless convergence of the traditional evidence should be under a legal framework to define the nature of electronic evidence to prove that evidence is the traditional electronic forms of electronic evidence.
