论网络版权之精神权利及其表现

摘　　要：完整的网络版权,应是权利人因网络作品的传播而享有的法律赋予的各项版权及相关权利的总和,包括精神权利和经济权利。就精神权利来说,作者在网络空间的精神权利既不是全新的——重新加以设定只会遭遇更多的麻烦,也不是一成不变的——墨守成规的结果不但影响网络产业的持续发展,还会导致整个网络版权使用制度的无序化。因此,网络环境下版权精神权利必须因网络技术和网络媒体的特点作出适时的调整,其中,发表权是指作品通过网络向不特定公众首次进行传播,署名权的行使则更加注重程序法上的证据规则,而对于修改权和保护作品完整权,在不可避免地遭受限制的同时更要维护版权人的基本权利。The complete Internet copyright of an obligee should be the sum of all kinds of the copyrights and other related rights to be protected by law if one of his/her work has been propagated on Internet, including both moral right and property right. The moral right of the obligee in Internet space is neither completely new nor invariable, i.e., more troubles will he brought if it is re-defined, and the sustainable development of Internet industry will be affected adversely by staying in old customs with the whole management system of Internet copyright disordered. Therefore, the moral right of copyright in Internet environment, including the rights to publish, sign, amend and keep the completeness, should be adjusted and regulated according to the characteristics of Internet technology and Internet media if necessary.
