中国银行业的行业管理权力的重置问题研究--一个国家法团主义视角

摘　　要：中国加入WTO后的国际俱乐部规则的约束,以及政府基于因自国有金融制度的效用函数的修正,促动了中国银行业的行业管理制度的革命。尽管政府监管的天然不完备性为行业自治管理提供了内生存在空间,但作为中国银行业的行业自治管理权诞生的起点逻辑的"政府委托"行为,同样也成为前者成长的路径依赖。正因为如此,国家法团主义为我们深入考察中国银行业的行业管理权的结构变迁提供了一个社会转型的全方位视角。我们有理由相信,随着政府体制改革的深入,一个由同业公会组织独立实施行业自治管理权的中国银行业自发秩序是可以期待的。Both the effect of timing constraints of being in line with international standards after China＇ s entering the WTO, and the Chinese governmental authorities＇ modifying its utility function based on independent variable of state - owned commercial banking organization, jointly motivate the institutional change of trade management right in china＇ s banking industry. Although the inborn incompleteness of governmental regulation provides the endogenous existential space for the establishment of the trade association autonomy in China＇ s banking industry, but the government en- trustment, ever as the initial natal conditions, furthermore turns into the path dependence of the trade association auton- omy in China＇ s banking industry. Basing upon the above, the state corporatism would be a panoramic perspective for us to make a thorough investigation and study on the institutional structural change of industry management right in China＇ s banking industry. It is quite within the reason to believe that, with the comprehensive implementation of the govern- mental system reform, it deserves expectation for us to reconstruct a kind of competition order in China＇ s banking indus- try which will be oriented by the trade association autonomy.
