品格证据规则的反思与重构

摘　　要：排除品格证据存在价值与事实的理由,由于品格证据立基于现代心理学的人格—行为理论,事实理由往往被忽视,但社会建构论心理学秉持的人格的建构性解构了这一理论。品格证据应该以社会建构论心理学为理论基础,并以向善的建构作为品格证据规则的建构理念,以品格原则上无相关性、但行为人的好品格具有相关性而坏品格不具有相关性作为建构原则。品格证据排除规则具有重大的法治价值,应该慎重对待当前品格证据运用的扩张之势。There are values and fact reasons in excluding character evidence, and the fact reason is often overlooked because of the character evidence is based on the theory of personality-behavior of modem psychology, but the constructive personality which holds by social constructionist psychology deconstructs the theory. Character evidence should be based on social constructionist psychology, so the construction of rules of character evidence should be based on the idea of ＂construction to goodness＂, and the principles are character evidence is irrelative in principle, but good character is relative and the bad is not. The rule of excluding character evidence has great values to rule of law, we should take the expansive use trend of character evidence seriously.
