对我国股市监管困境的法律思考

摘　　要：我国股市长期的非理性暴涨、暴跌及其与国民经济相背离的走势,暴露出股市监管陷入了失灵的困境。而股市制度缺陷、监管理念扭曲和监管职能错位是我国股市监管失灵的重要原因。在完善股市基本制度和监管制度的基础上重塑监管理念,正确定位监管职能,是我国股市监管走出困境的理性选择。China stock market＇s long-term non-rationality leads to the skyrocketing and crash and leaves the development contrary to the national economy. This phenomenon exposes the stock market supervision＇s fall into malfunction and a difficult position. But the stock market system＇s flaw, the supervision misconception and the supervision function dislocation is the major cause of China＇s stock market supervision malfunction. Remoulding the supervision concept to improve the stock market basic system and supervisory system＇s foundation and locating the supervision function correctly are the reasonable methods for China＇s stock market supervision to get out of the difficult position.
