摘　　要：诚信原则作为一般条款是法律解释的重要工具之一,而合理适用这一原则又需要统一的法律解释方法。只有在立法上确认诚信原则和自由裁量权,用法律解释方法对诚信原则的直接适用加以限制,才能使相关审判更加合理。The principle of good faith, being a general clause, is an important tool of legal interpretation, and reasonable application of it demands unified legal interpretation. Only confirming the principle of good faith and discretionary power in legislation, and limiting the direct application of the principle through legal interpretation, can the related trials be reasonable.
