取保候审制度运行现状及反思——对H市L区公安机关取保候审制度运行情况的调查

摘　　要：设立并运用取保候审措施的目的是为了尊重和保障人权,保证刑事诉讼的顺利的。通过对H市L区公安机关2006年、2007年取保候审制度运行现状的调查与分析,对如何完善我国的取保候审制度,从立法和司法方面提出如下建议:(1)增加取保条件的法律规定,明确规范标准和操作程序;(2)加强公安队伍建设,切实保障公安机关办案经费。The establishment and application of the mechanism of the guaranteed-pending-trial Bail is for the sake of respecting and guaranteeing human rights, of guaranteeing the smooth performance of criminal proceedings. The present thesis, based on the ease investigation and analysis of the status quo of the operation of this mechanism in a local police station, put forward the following suggestions for the purpose of perfecting China＇s mechanism of the guaranteed-pending-trial Bail： （ 1 ） to add the legal regulations relating to the conditions of being granted the right of giving the guaranteed-pending-trial bail and clarify the norms and standards of operation and the procedures; （2） to strengthen the construction of the policeman team and guarantee their judicial business expenditure.
