摘 要:劳务派遣雇主责任是一个跨劳动法和侵权行为法的命题,由于劳务派遣中共同雇主的存在和雇用与使用的分离,使得劳务派遣雇主责任有着区别于普通雇主责任的地方,本文从外部责任和内部责任的角度分别对其加以论述,并且提出了制度构建设想,以期对我国相关立法有所裨益。The employer's liability in labor service dispatching is a proposition which is across the labor law and the tort law. The existence of co-employers and the separation of hiring and using in the labor dispatching make the employer's liability different from the ordinary employer's one. The paper expounds the former from the perspectives of the external and internal liabilities, and comes up with the idea of building a system with a view to being helpful to the legislation of relevant laws in China.
