劳动合同期限的立法理念和实践裁断

摘  要:劳动合同期限制度问题实质上是固定期限和无固定期限劳动合同选择适用的问题。文章从立法现实到立法理念得出固定期限合同和无固定期限合同的协调的基本原则和精神。即劳动合同期限选择应关注公法和私法精神的共同追求;关注劳动者的保护和管理的结合;关注法理层面上和其他法律部门共通的精神,即自由,公平,正义,秩序,效率等。并提出我国劳动合同立法的修改建议,主要体现在以下几个方面:劳动合同期限制度的详细规定和构建,固定期限劳动合同的限制,扩大无固定期限劳动合同适用范围等。Research on the terms of the labor contracts virtually is the problem about choices that are made between fixed -term contracts non -fixed -term contracts. First, taking the Labor Contract in China into account, I analyze the principles one by one. Then I conclude the relations between social life and law, and find the progress and rules of the legislation on term of the labor contract. Consequently, from the legislation to the spirit, we should harmonize fixed - term contracts as well as non - fixed - term contracts. In general, on one hand, we should focus on the qualifications of both public law and private law ; on another hand, protection and management are both essential. Also the principles that are shared by labor contract law and other laws such as freedom ,equity ,justice ,order and efficiency should be gave enough attention to. At last, I put forward several suggestions about amendment of the terms of labor contracts. They mainly lie in the foundation of labor contract law system, the restriction of fixed - term contracts and expending the range of non - fixed - term contracts.
