摘　　要：相对于物质资本而言,人力资本具有"人力"和"资本"的双重属性,这个特性决定了人力资本产权界定应遵循人力资本的特殊性质。人力资本产权包括所有权和收益权,承认人力资本所有权的私有性和人力资本收益权的可交易性是界定人力资本产权的基础,科学界定人力资本产权可以提高人力资本效率,优化配置结构。The human capital, which combines ＂human＂ and ＂capital＂, provides the standard to define human capital property rights. The human capital property right includes the ownership rights and the income rights. Admitting ownership rights as well as the transaction of income rights is the foundation to define the property rights of human capital. So accurately defining human capital property rights could not only increase human capital efficiency but also optimize allocation.
