法官自由裁量权与涉台民商事法律冲突的协调和解决

摘　　要：法官自由裁量权的行使,对于海峡两岸民商事法律冲突的协调与解决起着积极的促进作用,并且贯穿在处理涉台民商事争议的始终。有关法律事实的定性、确定案件的管辖权、决定法律适用及司法协助等等都离不开法官的自由裁量。然而,法官就涉台民商事法律冲突的协调与解决行使自由裁量权也要受各种主、客观条件的限制。Judicial discretion of Judge can promote coordinating and solving the Cross-Strait conflict of civil and commercial laws, and it passes through all the process of settling the disputes. On classification, jurisdiction, application of law and judicial assistance depend on the judge＇ s judicial discretion. But in coordinating and solving the Cross-strait conflict of civil and commercial laws, the judicial discretion must be limited by subjective and objective conditions. The judges have to improve their abilities or qualities.
