摘　　要：本文通过对民事责任与刑事责任的性质界定,明确了民事责任与刑事责任的不可替代性。在分析我国目前刑事精神损害赔偿制度现状的基础上,对我国刑事精神损害赔偿制度提出相应的立法建议。Through the defining of characters of civil and criminal liability,this article specifies the irre-placeability of civil and criminal liability.Based on the current situation of China’s compensation system for mental damage in criminal cases,this paper puts forward the corresponding legislative suggestions to China’s compensation system in this respect.
