摘　　要：文章对原国家教育委员会“禁止在校大学生结婚”规定的违法性和绝大多数高校继续“禁婚”的做法进行了质疑 ,并从宪法、法律 (理 )的依据和效力以及西方发达国家高校开放的态度和现状进行分析 ,以肯定的态度论证了大学生结婚的合法性和可行性。This paper raises doubts about the regulation of “ forbidding university students to get married at school ” which made it illegal for university students to get married according to what was required by the former State Education Commission and the practice that most universities continue to “ prohibit marriage”. Analyzed on the constitution, the law, and the open attitude and current situation of universities in western developed countries, the legitimacy and feasibility that university students can get married is stated with a positive attitude in this paper.
