摘　　要：我国《刑法修正案(六)》规定的组织残疾人、儿童乞讨罪有力地保障了残疾人和未成年人等弱势群体的合法权益,而以暴力、胁迫手段组织残疾人、儿童实施乞讨行为则是本罪犯罪构成上的本质特征。这一本质特征也是司法实践中正确认定组织儿童卖花和组织成年人强行乞讨等与本罪相关的组织性乞讨行为性质的依据。The crime of organizing the handicapped and children to beg in the Criminal Law Amendment （6）protects the legitimate fights and interests of vulnerable groups including the handicapped and minors effectively. Organizing the handicapped and children to beg by violence or force is the essential characteristic of the crime constitution. The essential characteristic is foundation of cor- rect confirming nature of organizing children to sale flower and organizing adult to beg by force in judicial practice.
