论建立我国行政听证制度的意义和价值分析

摘　　要：确立和实施听证制度的重要意义在于推动中国宪政事业的发展,贯彻落实党的十七大报告精神,行政听证制度的价值在于听证制度有利于保障程序公正、行政决策科学化和民主化,有利于政府与民众之间的交流、认同和理解,提高行政决策的公信力、行政效率、行政质量。完善中国行政听证制度,应该提高认识,正确看待听证制度;切实发挥听证制度的作用,完善法制,规范听证制度,实现听证制度的法制化;加强对行政听证结果的追踪处理,充分发挥行政听证的现实效能。Establishment and implementation of the hearing system in China is of much significance to promoting the constitution and implementing the spirit of 17th Party Congress＇ report. The true value of administrative hearing system lies in ensuring procedure fairness and scientific administration and democratic policy-making and is in the interest of the communication, acceptance and mutual understanding between government and people and improving the credibility of administrative decision-making, the administrative efficiency and the quality of administration. To perfect China＇s hearing system, it is suggested that the awareness should be strengthened; a correct view of the hearing system be held; the hearing system be effectively utilized; the legal system be enhanced; the hearing system be standardized; the hearing system be legalized; the follow-up treatment of administrative hearing results be strengthened; and full play be given to the actual function of the administrative hearing system.
