高校体育伤害及其法律思考

摘　　要：体育伤害事故是学校体育活动中不可避免的一个事实,运用法律手段妥善处理事故,是解决事故纠纷的主要途径。在伤害事故中,一要研究法律,明确学校和体育教师在伤害事故中的法律责任;二要重视预防,把伤害事故降到最低限度,切实维护学校、体育教师和学生的合法权益。文章结合学校体育的具体实际,对学校体育活动事故适用的法律范畴、法律责任承担和免责条件进行分析和探讨。Aeeidents in campus physical education activities are unavoidable which seriously torment physical education teachers and affect the daily teaching schedule. The main approach to mediation is through legal means. To deal with sports injuries properly, relevant laws need to be studied to make clear the legal liabilities of beth school and teachers in the first places. Secondly, special attentions need to be paid on prevention to reduce the accidental injuries to its minimum. Meanwhile the legal rights of schools, physieal education teachers and students should be firmly safeguarded. This paper briefly discusses the present legal situation of injuries in Chinese campus physical edueatiou activities from relevant laws and regulation.
