略论凉山彝族民间调解

摘　　要：在奴隶制下的凉山彝族社会,由于没有形成统一的政权组织和司法行政机关,人们之间发生的纠纷主要靠社会中德高望重的德古、苏易按照习惯法进行调解。这种民调解方式在凉山有着很深厚的群众基础,对社会的安定团结和稳定起了很大的作用。但因为它源于奴隶社会,也存在消极的因素,我们应本着去其糟粕、取其精华的原则,积极引导,使其和国家法律、法规相融合,为建设和谐、稳定的凉山服务。The society of Liangshan Yi People under slavery was in absence of unified government organizations and judicial administrative organs. So the mediation of the disputes between people were mainly mediated by the respected community people in accordance with customary law. Such mediation has a deep mass base in Liangshan, so it＇ s very important to the social stabilily and unity . However, as it originated from slave society, there are also negative factors. We should hold on the principle of discarding its dregs, and choosing the best. We should actively guide it, and make it serves the building of harmonious and stable Liangshan.
