“先王世界”崇拜与中国古代法起源的特征

摘　　要：本文从中国历史早期的祖先崇拜入手,分析了儒家如何利用传说时代的英雄神话构建了"先王世界"这样一个信仰的彼岸世界,并加以历史化。儒家以伦理为桥梁沟通了作为彼岸世界的"先王世界"与此岸现实世界的关系,使"先王世界"在现实世界有了实践的意义。这一实践意义,决定了中国古代法在起源上表现为以礼教、德治为特色的人治。This article begins with the ancestors worship and analyzes how the Confucians constructed and historicized an ＂ancient king＇s world＂ with the heroic myth. The Confucians bridged the ＂ancient king＇s world＂ as the other shore world and the real world with ethics so as to give practical meaning to the ＂ancient kings world＂. This practice had decided that the ancient law of China was the rule by people with the rites and virtuous rule as the characteristics in the origin.
