摘　　要：民间文化遗产是人类的宝贵财富,不仅具有文化价值,而且具有商业开发价值。文化遗产不但需要保护,还需要开发。应在保护中开发,开发中保护,两者相互依存,彼此构成一种函数关系。有必要建立一种科学合理的知识产权法律保护机制,使得民间文化遗产既受到有效保护,又使蕴涵的商业价值能够充分释放。Folk cultural heritage is a treasure of human being, and it has no only cultural value, but commercial value as well. The cultural heritage needs to be protected and developed. Without protection there is no development, and without development there is no protection, and these two factors depend on each other. A scientific and reasonable protection mechanism of IPR law should be established, with its goal to protect the folk cultural heritage and give full play to its commercial value.
