证券交易所信息资源产权属性研究

摘　　要：通过对证券交易所信息资源的外延分析表明,证券交易所信息资源的产权属性与信息资源的形成方式及其形态特征有直接的关系。以上海证券交易所为例,归纳出了基于产权属性的证券交易所信息资源的外延细分体系,使证券交易所在其信息资源开发利用中的角色权限及对上交所信息产权实施分类保护的科学依据更加明了。在当前环境下,证券交易所信息资源开发利用工作的重心应放在构建基于公司制的产权性信息资源体系和强化《证券信息经营许可合同》的产权保护力度上,同时也要保护市场参与者的私密信息。An extensional analysis of the stock exchange information resource indicateS that there are very direct relations between the stock exchange information resource property right attribute and the information resource mode of formation and the morphological features. Taking Shanghai Stock Exchange as an example, this paper sums up the stock exchange information resource extension segmentation system based on the property right attribute, so that the role of stock exchange is more clearly defined in the development and use of its information resources, and the scientific evidences are made stronger for Shanghai Stock Exchange in providing classified protections for information property right. Under the current environment, the focus task of the stock exchange in developing and applying information resource should be constructing a property right information resource system based on corporate system, and strengthening the power of Negotiable Securities Information Management Permission Contract in the protection of property right, and protecting the market participant＇ s private information.
