摘  要:我国高校与教师之间存在的纠纷日趋增多而且具有一定的特殊性,加上《教师法》中规定的教师申诉制度存在明显的不足,迫切需要建立高校内部的教师申诉制度。建立高校内部教师申诉制度对于促进高校依法治校、维护教师的合法权益有重要意义。教师申诉的程序由提出申诉、受理申诉和对申诉的处理三个环节组成,并依此进行。另外,有必要建立起调查制度、利益回避制度、听证制度、合议制度、说明理由制度、结果反馈制度、责任追究机制、结果执行监督机制等基本制度规范。The disputes between universities and teachers in China are increasing gradually together with certain particularity. Furthermore, there are evident deficiencies with the teacher appeal system stated in the Teacher Law, it is an urgent need to establish university internal teacher appeal system, which is of great significance to establish university internal teacher appeal system for the promotion of governing university by law and the safeguarding teachers" legitimate rights and interests. The procedure of teacher appeal is made up of three links which are to lodge an appeal, to accept and hear the appeal and to deal with the appeal, which will go ahead according to the procedure. Moreover, it is necessary to establish the basic system standards such as investigation system, interest challenge system, public hearing system, collegiate system, reason-giving system, feedback system, responsibility investigation system and supervision mechanism of execution.
