摘 要:目前国内外学界对商品房预售登记的法律属性缺乏统一认识。虽然我国的商品房预售登记在实践中对维护交易秩序发挥了一定的积极作用,但是在实践中往往片面强调登记的行政管理功能,忽略了登记的物权效力,以致于预购者的权益得不到有效保障,所以我们有必要借鉴国外成熟的立法经验,完善我国的商品房预售合同登记制度,将其定性为预告登记,以达到保护消费者权益之目的。At present, domestic and foreign scholars lack a common understanding of the legal nature of pre - sale registration of commercial housing. Although pre - sale registration of commercial house in China plays a positive role to a certain degree in keeping transaction order, it emphasizes one- sidedly on the administration function of registration in practice and neglects the validity of property right of registration so that the purchaser' s right can not be guaranteed. Therefore, we should learn from mature foreign legislative experience to improve our system of pre - sale registration of commercial housing. We should fix it as advance notice registration to protect the consumer's right.
