摘　　要：我国非法证据排除规则对非法获取的刑事鉴定结论是否应当排除没有明确规定。从鉴定结论的性质,国际社会的通行做法以及人权保障等三个方面来看,非法获取的刑事鉴定结论应当排除,但应适当限制排除的范围。The situation that the criminal export conclusion which obtained from illegal way whether eliminate or not does not refer in the formula to eliminate lawless evidence. The lawless criminal expert conclusion should be eliminated form the nature of expert conclusion, international practice and human rights protection. However, the range to eliminate should be restricted properly.
