论混合身份在纯正身份共犯中对刑事责任的影响

摘　　要：纯正身份犯是刑法规定的以行为人所具有的特定身份作为犯罪构成要件的犯罪。在混合身份共犯中,非身份者在特定的条件下,可以与身份者共同构成纯正身份实行犯的共犯,可以构成纯正身份犯的教唆犯、帮助犯;非身份者在与身份者构成共犯划分责任时,如果利用了身份者的身份,应以身份者的犯罪行为的性质定罪量刑;如果没有利用身份,则应具体区分。The standard status crime is the crime that the status as the basic condition is provided by the criminal law. In the accomplice of the mixed related-status crime, the person without status can be the perpetrator of the standard status crime in the joint offence ; also can be the abettor or the assister of the standard status crime. On the division of responsibility for the person with status and the person without status in the joint offence, if the person without status who makes use of the status of the person with status, he should be convicted and sentenced in accordance with the characteristic of the crime of the person with status; if not, it is based on the function of the person without status in the joint offence.
