摘　　要：随着电子商务的巨大发展,作为其基础的商业方法软件应如何保护进入了众人的视野。通过对美国历史上的案例进行总结,并介绍最近几例具有广泛影响的案例,包括e-Bay,In Re Bilski和Ex Parte BoLi案,借以探求美国商业方法软件专利保护的脉络和动向。With the rapid development of electronic commerce, the protection of business method has gained wide attention. Accord- ing to this, it＇s of great importance to summarize the relevant cases in American history. In order to seek the clue and tendency of American business method patent, several recent eases of widespread influence are introduced, including e-Bay, In Re Bilski, and Ex parte Bo Li.
