关于在保护性医疗制度下尊重患者知情同意权的思考

摘　　要：患者知情同意权是维护患者权益、减少医疗纠纷、改善医患关系的关键所在。维护患者的知情同意权,要求医方积极、有效地履行如实告知义务。这与传统的保护性医疗制度对患者的病情保密的主张存在着不可避免的矛盾。正确认识二者间的矛盾,找到有效的解决方法,对于更好地维护患者知情同意权,保障病人健康权益是十分重要的。The informed consent right of patients is the key to uphold the rights and interests of patients, reduce medical disputes and to improve the doctor--patient relationship. To safeguard the informed consent right of patients, the hospitals are required to fulfill the obligation of truthfully informing, which inevitably conflicts with the illness confidentiality of patients in traditional protective health care system. To make a correct understanding of the contradictions between them and to find effective solutions are very important to better safeguard the informed consent right of patients, and their health rights and interests.
