摘　　要：我国在证人出庭理论研究和制度设计过程中,往往忽略了证人宣誓制度与证人出庭行为内在逻辑关系的关注,从而导致证人出庭研究和证人宣誓制度研究的脱节,极大减低了证人出庭研究和制度设计的实效性,加大了证人不出庭行为的随意性,从而也证实了证人不出庭行为的"合理性"存在。With regard to the theoretical study of witness appearing in court and system designing process, we often neglected the system of witness＇ oath and the internal logical connection of the conduct of witness appearing in court, which led to the disjointedness of the study of witness appearing in court and the system of witness＇ oath. It not only lowered the effectiveness of the study of witness appearing in court and system designing, but also aggravated casualness of the conduct of witness not appearing in court. Those above confirmed that the conduct of witness not appearing in court reasonably existed.
