摘　　要：针对当前征地中,权力行使者无视权力运作的基本范式,越界滥用征地权,致使征地乱象纷呈的现象,指出为征地权设定清晰的边界与严格的程序,在中立性、非营利性及权责相适应的原则框架下对其进行有效规制,并随着政绩考核模式的转变以及问责制的建立,最终形成征地权良性运作的稳固范式,是破解征地困局之良策.At present,the confusion during land expropriation is due to the disregard of the basal rule of the land expropriation power.To set the clear rule and rigorous procedure of the land expropriation power,to restrict such power under the principle of neutrality, nonprofit and responsibility,to change the pattern of performance evaluation of officials,and to found the accountability,are the path to settle the predicament of land expropriation.
