德法兼治是构建社会主义和谐社会的必要条件

摘　　要：没有健全的法制,良好的社会道德秩序就不可能建立;而没有良好的公民道德素质,法制建设也会缺乏必要的道德基础。因此,构建社会主义和谐社会,既要有社会主义法制作为保障,也离不开良好社会道德秩序的支撑。面对带有法治经济和道德经济双重属性的社会主义市场经济体制,一方面,需要用法治维护市场经济的正常秩序,实现宏观调控;另一方面,要提高公民的道德素质,增强公民遵纪守法的自觉性。A good social order can never be established without perfect legal system and the legal system would be lack the moral basic without citizens＇ good moral qualities. So for the harmonious socialist society construction, both socialist legal system as the safeguard and the normal orders of socialist morality as the firm backing are needed. On the one hand, the system of socialist-market economy, which has a dual attribute of the economy under the rule of law and the economy governed by morality, is in need to maintain the normal order of market economy and realize macro-adjustment and control. Compulsory measures of law must be used in order to stop and punish the wrong behaviors of seeking for private interests at the price of harming the others. On the other hand, moral legislation and enforcement should be carried out so as to ensure its equal, impartial and reasonable nature.Citizens＇ moral quality should be improved and their consciousness of complying with the laws should be enhanced. Therefore, the combination of the rules by law and by morality is the essential condition of establishing a harmonious socialistic society.
