关于生态文明背景下代物诉讼制度的思考

摘　　要：由于我国诉讼法对原告资格规定了严格的条件,环境公益诉讼的司法举步维艰。因此,我们引入代物诉讼制度成为必要。文章意在引入代物诉讼制度,分析其成立的理论基础,并提出相应制度的运行架构,以期对我国环境公益诉讼制度的改进与完善有所裨益。Because litigation against our country establishes strict eligibility conditions about the plaintiff, the judicial system of environmental public interest litigation can not carry out . So it is necessary to bring into generation of actions in tern. On the base of introducing generation of actions in rem in this article, we can analysis the theoretical basis for its establishment, and propose the framework the of the corresponding operation system,so as to benefit the improvement and perfection of our environmental public interest litigation system in China.
