摘 要:相比《物权法》的相关规定,《物业管理条例》在理念上存在两个重大偏差。首先,在物业管理的问题上否认了业主自治,不允许业主管理自己的物业,要求必须聘任物业服务企业。其次,强调政府通过行政权力"划分"物业管理区域,而不是根据业主的财产权"确认"物业管理区域。正是由于这些问题的存在,《物业管理条例》的相关制度与《物权法》存在冲突,需要在新的理念指导下重新设计。The Regulations on Realty Management underwent a revision in 2007 after the Property Rights Law was put into effect. As far as the author is concerned, realty management should be based on self - management by property owners. Whether or not to hire a third person to provide maintenance service is up to property owners. Furthermore, realty area shall not be decided by government agency but be determined in line with property rights. These ideas had been carved into the Property Rights Law. However, The Regulations on Realty Management has not implemented them at all. This paper will demonstrate the differences and conflicts between the two laws.
