完善《公务员法》“违法命令不执行”条款的思考

摘　　要：作为《公务员法》的重要条款,公务员对上级违法的决定或者命令应当采取的态度不能仅仅落脚于可否说"不"上,还应该甚至主要应该更多地着眼于具体的前提条件、权利义务、配套细则、救济方法等方面,从而保证法律规范明确具体、切实可行。As an important clause of The Civil Servants Act, the attitude adopted by civil servants towards unlawful decisions or orders made by their superior should not simply be whether civil servants can say＂no＂or not. Civil servants should pay more attention to the concrete preconditions, rights and obligations, complementing by-laws and remedy methods, so as to refine and perfect the law in order to ensure the law is clear and definite, concrete, realistic and practical.
