论中国古代法律对赌博的规制

摘　　要：赌博作为一种社会文化现象,其历史痕迹几乎贯穿人类文明的始终。赌博违背了中国社会主流文化传统和价值观念,因而一直被法律所禁止。本文通过对中国古代禁赌法律实践的总结与研究,指出其具有法令为辅、教化为主;法网严密、用刑苛峻;重典治吏、严惩官赌;禁而不绝、明禁实驰等显著特点,以期为我国未来禁赌立法提供借鉴。Gambling,as a phenomenon of social civilization ,has run though almost all phases of human civilization development.How- ever,it ran counter to mainstream of Chinese social civil traditions and values,which made it forbidden by laws in all dynasties.Tbe paper summaries and researches law practices of gambling prohibition in Chinese ancient times,and point out their characteristics, such as education was prior to law,law rules were strictly established,and criminal punishments were rigorous,convicted officials would be put on worse punishment,and the laws could not extinguish gambling and to some extent indulged it.The paper is made to do some devotions to gambling prohibition legislation in the future in our country.
