证据学视野下的讯问犯罪嫌疑人同步录音录像

摘　　要：讯问犯罪嫌疑人录音录像的证据类型是动态的,根据证明目的的改变而改变,一般情况下,它为口供的固定方式;特殊情况下,又可以转化为视听资料。在审查其证据能力的时候应当以"没有异议可采,有异议有限可采"为标准。面对证据立法上的滞后,应该加快立法完善的步伐。建议在修改刑事诉讼法时候,在有关证据的章节中,增加侦查讯问录音录像相关的法律条文,严格规范讯问录音录像的操作规则及程序。The evidence types are dynamic,do audio and video recordings when inquest suspects.Changes according the evidence purpose changes. Commonly,it is the hxed mode ot affidavit; especially,it also can transform into seeing and hearing data. When examine the evidence ability, should take ＂No objection can be taken, there is a limited objection to the admissibility of＂as standard.When facing the lag of evidence legislation,we should quicken the improvement of legislation.Suggest when recompose the code of criminal procedure, in the chapters of evidences,we can add the legal provisions of audio and video recordings of interrogation,regulate the operation rules and procedures of audio and video recording of interrogation strictly.
