摘　　要：公安行政检查攸关公民基本权益之保障,然而,公安行政检查无论在理论上还是在立法中,均未受到足够的重视。公安行政检查是一种独立的外部职权行政行为,应与公安行政调查和刑事搜查相区分。为贯彻法治主义和人权保障原则,公安行政检查应从设定权、法律保留、法律要件和程序等方面加以规制。Police administrative inspection is related with the guarantee people＇s basic rights and interests. However, it＇s lack of enough attention no matter in theory or in legislation. Police administrative inspection is an external administrative act of authority, which should be distinguished from police administrative investigation and criminal search. Police ad- ministrative inspection should be strictly regulated by law in permission, law restraint, law requirement and legal procedure,so as to carry out the principles of constitutionalism and guarantee of human rights.
