摘　　要：目的从适用规则与适用程序两个方面对食品药品行政处罚裁量权的内部约束机制进行了有益的探索。方法采用理论研究与实证研究相结合的方法,通过法条梳理与实际调查,评价与分析目前处罚裁量权在规范与操作层面存在的问题及原因。结果与结论目前,行政执法裁量权内部约束机制的研究相对薄弱,在一定程度上造成了理论与实践的双重缺失。Objective To explores the reasonable operating mechanism of the discretion of administrative penalty in food and drug field,from the application rules and procedures both.Methods By theoretical research and empirical study,comparing articles and carrying on investigations,the existing problems and reasons on the discretion of administrative penalties currently in operation and standardize were evaluated and analyzed.Results and Conclusions At present,the study of the internal mechanism on the discretion of administrative law is relatively rare, which, to a certain extent, led a double loss in theory and practice.
