美国实体性正当程序的司法功能及其对我国的启示

摘　　要：实体性正当程序包括经济上的实体性正当程序和非经济的实体性正当程序,它促进了美国司法能动主义的传播并呈现出两方面的司法功能:一是作为实质的司法审查标准,提供了能动主义的违宪审查工具;二是作为基本的人权重构标准,为发现宪法未列举的权利提供了能动主义的司法解释空间。实体性正当程序呈现的司法功能对中国宪政体制发展和司法程序变革具有启示性意义。Substantive due process, including economic substantive due process and noneconomic substantive due process, promotes the development of American judicial activism and has two judicial functions ： a substantive judicial review standard which provides a kind of constitutional review tool of judicial activism and a basic re -constructive standard of human rights which provides the most active space of constitutional interpretation aiming to series of civil rights and freedom not enumerated in Constitution. The judicial functions of substantive due process are helpful for the development of constitutional politics and judicial reform in modern China.
