赋予业主自治性机构法律主体地位理论探究

摘　　要：现行法律法规不仅没有对业主自治性机构的法律主体资格作出明确规定,甚至连业主自治性机构的归属客体都处于模糊状态。从法律关系上来看,业主团体、业主大会、业主委员会三者的关系类似于公司法人、股东大会、董事会三者的关系。业主团体是享有权利、义务的法律主体,业主大会是业主团体的意思表示机构和权力机构,业主委员会是业主大会的执行机构。在一个社区意识真正成型的社会,业主团体是一个具备共同利益指向的社会团体,为维护这个团体本身和各团体成员的合法权益,赋予其正当的法律主体资格是正当的也是必要的。The current laws and regulations have no explicit stipulations on the capacity as a subject of law of the owners＇ autonomous body, and even the affiliation object of the owners＇ autonomous body is made ambiguous. From the point of view of law, the relations between owners, the general meeting of owners and the committee of owners are similar to the relations between the corporate juridical person, the general stockholders＇ meeting and the board of directors. Owners are the legal body enjoying the rights and fulfilling the duties. The general meeting of owners is the organization and organ authority of owners who can express their ideas, while the committee of owners is the executive organization of owners. In a society in which the sense of community is formed, owners is a social group having common interests. In order to safeguard the legal rights of the group itself and its members, it is indispensable to stipulate the form capacity as a subject of law of owners.
