摘　　要：由美国次贷危机引发的华尔街金融风暴早已演变为席卷全球的金融危机,受其影响,美国、日本、欧洲许多国家都出现了不同程度的经济衰退。我国经济也不可避免地受到严峻挑战和重大考验,影响和冲击最大的是我国中小企业。金融危机形势下,一直制约我国中小企业发展的"瓶颈"——融资难,成为当前国内理论界和企业界的焦点。探索中小企业的融资问题及其法律对策,对保障中小企业走出困境,实现转型升级,无疑具有重要的理论价值和实践意义。The US loan crisis has been developed from the Wall Street finance storm into the financial crisis having swept the globe, by whose effect the economic downtum to varying degrees has all been appeared in the US, Japan, a lot of countries of Europe. Our country economy has also experienced the inevitable accept grave challenge and significant, the affecting and pounding to our country mediumsized and small enterprises is maximal. During the financial crisis, the ＂bottleneck＂ - the financing problem to restrict our country mediumsized and small enterprises to develop has become the focal point of the current homeland theory boundary and business circle. Beyond doubt, discussing the financing problem of the medium - sized and small enterprises and its law countermeasure to ensure the mediumsized and small enterprises step off the difficult position and realize transformation and upgrading, has important theory value and Practical significance.
