摘　　要：全球社会经济、政治、科技的更新变革,以及终身教育观和人力资本理论的普及,导致世界主要发达国家先后开启了成人教育法制化的进程,以此推动本国成人教育事业的发展。我国成人教育立法工作尚处于理论研讨阶段,但立法的法治基础、理论依据、时代需求已经成熟。因此,在考察、参酌、比较国外成人教育立法先进经验的基础上,结合本土资源,催生出一部能够规范我国成人教育的系统法律,不仅是填补我国教育法律体系中"成人教育法"这项重大空白、顺应和促进教育事业发展的重要举措,更是使依法治教的法治观念走进人心、为我国法制现代化事业添砖加瓦的有效路径。The global socio-economic, political, scientific and technological updates and changes, as well as the popularization of the life-long education philosophy and the human capital theory result in that world＇s major developed countries have opened the adult education legalization as a means of promoting national development of adult education. China＇ s adult education legislation is still at the theoretical study stage, but the rule of law, theoretical basis, and the requirements of the times for legislation are ripe. Therefore, with the observation, reference and comparison of advanced foreign experience in adult education legislation on the basis of local resources, to hasten the birth of an adult education law in China, is not only an initiative to fill in ＂Adult Education Act＂--a significant blank of our educational legal system, to promote the development of education enterprise, but also an effective way to teach the rule of law into people＇ s minds for the modernization enterprise of China＇ s legal system.
