摘 要:由于我国刑事立案管辖制度对立案管辖权的划分不够清晰、合理,导致司法实践中立案管辖制度规定的粗疏,且法律、司法解释、各部门规定的内容不统一,缺乏协调性;公、检、法三机关的刑事立案管辖权划分不科学、交叉管辖、互相扯皮的现象时有发生;立法上未明确规定国家安全机关、军队保卫部门的刑事立案管辖权限,理论界对于监狱是否应该享有立案管辖权也存在争议。文章从立案管辖的划分标准等三个角度对我国现行刑事立案管辖制度提出质疑,为现行制度的合理运行提出一些完善相关立法的补救措施。Because division of placed on file Jurisdiction in China's System of criminal cases under the jurisdiction is not clear and reasonable, leading to its regulations in judicial practice being inattentive, and the content in legal, judicial interpretations and all departments is not uniform and lack of coordination. The division of jurisdiction of criminal cases is unscientific in public, inspection and legal authorities; as a result cross-jurisdiction and buck-passing phenomena have frequently occurred. Legislation is not clear in criminal case jurisdiction of the national security organs and the armed forces to defend the department, so theoretical circles should have placed on file for the jurisdiction of the prison are also in dispute. The author questioned on our current system of jurisdiction in criminal cases from such three an- gles as criteria for the classification of the jurisdiction and proposed remedial measures to improve the relevant legislation in the existing system.
