摘　　要：电子技术的飞速发展以及网络的普及,不仅给著作权的保护提出了新的课题,也给权利限制或合理使用制度带来了新的挑战。随着各种各样的作品在网络中的大量涌现,著作权人与网络经营者的纠纷与诉讼也此起彼伏。因此,如何在网络环境中适用权利限制成为理论界和实务界共同关注的课题。以国际条约和各国有关权利限制的规定为基础,结合近几年发生的网络纠纷案例,分析和论述网络环境中权利限制的适用。With the development and popularization of Internet, more and more people are reading news and articles through Internet. lnternet has become one of the most important media masses. However, how to protect copyright and its related rights is becoming an urgent problem. Especially in Internet environment, how to define fair use is a comparatively new study. Combining with cases related to fnternet infringement, the application of fair use in Internet is analyzed and studied based on regulations of international treaties and copyright laws of different countries.
