数字版权中财产权利合理使用制度设计

摘　　要：作者基于数字技术给版权带来诸多的影响的分析,并在坚持版权法保护理念的基础上,设计出版权人在数字条件下传播作品的专有权利和对这种专有权利限制之合理使用制度。作者通过对合理使用性质的分析得出合理使用是版权权利重要的限制,并指出我国版权法中合理使用制度规定的不足,将法理学、社会学和法律经济学的方法应用于合理使用制度的研究,得出现代网络技术条件下保留并扩大合理使用制度范围的必要性,并做出具体制度的设计。Based on the analysis of the impacts on copyright by digital technology and the concept of copyright protection, the author designed a fair system in the exclusive right and its restrictions on transmitting works with digital technology. The author also pointed out the limitations in the Chinese copyright law and suggested the necessity to maintain and expand fair use system under modern digital technology condition.
