摘　　要：现代意义上的中国法制史学科产生于20世纪初,至今该学科的研究中存在诸多问题,解决这些问题的关键之处在于方法论的更新。发生学研究方法最初是研究生物遗传问题的一种方法,后来该方法被引入到对人类思想、制度的产生历史的研究中来,今天该方法已经成为历史学研究中的重要方法。中国法制史学科作为历史学的一个分支学科,有必要引入该方法,而且也具备了引入该方法的条件。法发生学的引入对于中国法制史学以及其他部门法学研究都具有重要意义。History of China＇ s Legal Systems as a branch of learning in its modern sense came into being in the early twentieth century. There are still many problems in this field to be solved via new methods. Genetic method, which used to be applied in the study of bio - genetic problems, is later introduced in the study of human thoughts and systems. Today, genetic method has become very important in the study of history. It is necessary and feasible to apply the genetic method in the study of the history of China＇ s legal systems, which is also of great significance to other branches of law study.
