摘　　要：交涉是各方主体围绕纠纷解决所展开的互动行为及其过程。交涉的性质、交涉得以展开的基础、交涉的层次和内容、开展交涉的过程以及如何通过交涉推动纠纷解决进度,是我们理解真实世界中纠纷解决过程的关键所在。The ＂negotiation＂ means the interactive behaviors and process among all parties for dispute settlement. The keys to comprehend the dispute resolution process in the real world are the character of negotiation, the basis on which negotiation can develop, the strata and contents of negotiation, the process to develop negotiation, as well as how to impel the dispute resolution progress.
