摘　　要：劳动就业权是指在宪法和其他法律保障下我国公民获得劳动就业机会并在劳动过程中得到基本保障的权利,它是公民的基本权利,是人权的一项重要内容。我们需要进一步梳理劳动就业权作为基本人权及宪法性权利的真正内涵以及国家对该权利实现所负的义务,并从制度建设的高度探索公民劳动就业权法律保护的路径。The employment right refers to the right that the citizens in China obtain employment and their basic needs are ensured in the process of laboring under the protection of the constitution and other laws. It is the basic right of the citizens and an important item of the human right. We need further to sort out the genuine connotations of the employment right as a basic human right and the obligation that the state should assume. It also explores the law protection paths of the citizen labor right from the perspective of system construction.
