论《食品安全法》立法理念之不足及其对策

摘　　要：2009年2月28日第十一届全国人民代表大会常务委员会第七次会议通过的《中华人民共和国食品安全法》自2009年6月1日起施行,但《食品安全法》在立法理念上存在着三大不足:对食品安全概念的理解不足;对食品标签的重要性认识不足;对充分发挥消费者的制衡作用认识不足。这不利于充分发挥《食品安全法》的震慑作用。因此,在充分论证《食品安全法》立法理念不足的同时,提出解决不足之措施对于建立食品安全制度尤为必要。On February 28, 2009 the seventh conference of the 11 th Standing Committee of the National People＇s Congress adopted ＂the People＇s Republic of China Food Safety Law＂ and implements it on June 1,2009. After reading the Food Safety Law, it is easy for one to find that there are three weak points in it. The first one is that the Food Safety Law misunderstands the concept of food safety. The second is that the Food Safety Law overlooks the importance of food label. The third one is the Food Safety Law dose not put emphasis on rule of consumers in struggling against fake food producers so that. the Food Safety Law can＇ t play a great nile. After pointing out the three weak points in the food safety legislation the author has put forward some proposals in dealing with the problems.
